By creating an account or using Financier ("the Service"), operated by Davis.IO LLC ("we", "us", "our"), you agree to these Terms and Conditions and our Privacy Policy. These terms constitute a legally binding agreement between you and Davis.IO LLC.

2. Description of Service

Financier is a personal financial dashboard application that allows users to view, track, and manage personal financial information. The Service is provided for informational and organizational purposes only. We do not provide financial advice, investment advice, tax advice, legal advice, or any other professional financial services.

3. Not Financial Advice

IMPORTANT: The Service does not constitute financial, investment, tax, or legal advice. Any information displayed in the Service is for informational purposes only. You should consult with a qualified financial advisor, accountant, or attorney before making any financial decisions. Davis.IO LLC expressly disclaims any liability for financial decisions made based on information displayed in the Service.

4. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. We reserve the right to terminate accounts found to belong to minors.

5. Account Responsibilities

You are responsible for:

You may not share your account, create multiple accounts, or use the Service on behalf of others without explicit permission.

• Reverse engineer, decompile, or disassemble the Service

The Service integrates with third-party services including Plaid for bank account connectivity. Your use of these integrations is subject to the respective third parties' terms and conditions. Davis.IO LLC is not responsible for the actions, content, or privacy practices of third-party services.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. DAVIS.IO LLC EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Financial data displayed is accurate, complete, or current
• Any defects or errors will be corrected
• The Service will meet your specific requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DAVIS.IO LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, FINANCIAL LOSSES, OR ANY OTHER DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total cumulative liability to you for any claims arising from these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred dollars ($100.00).

10. Indemnification

You agree to indemnify, defend, and hold harmless Davis.IO LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any rights of any third party.

11. Account Termination and Data Deletion

You may delete your account at any time through Account Settings. Upon deletion, all personal data associated with your account will be permanently and irreversibly removed from our systems. We may also suspend or terminate your account if you violate these Terms, with or without notice.

12. SMS Messaging

By providing your phone number, you consent to receive SMS messages from Financier for account verification and security purposes. Message and data rates may apply. Message frequency varies. Reply STOP to opt out. Reply HELP for help. For support, contact support@financier.app.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a notice in the Service. Continued use of the Service after changes constitutes your acceptance of the updated Terms.
